IN NO EVENT SHALL ROUTEPREDICT'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government actions.

12. Dispute Resolution and Arbitration

Informal Resolution: Before filing any formal dispute, you agree to first contact us at kushnerdigital@gmail.com to attempt to resolve the matter informally.

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and shall take place in the state where RoutePredict is located.

Class Action Waiver: You agree that any arbitration or court proceeding shall be limited to the dispute between you and RoutePredict individually. You waive any right to participate in class actions, collective actions, or other consolidated proceedings.

Exceptions: Either party may seek injunctive relief in court to prevent irreparable harm or to enforce intellectual property rights.
